Nova Vida Picnic — Terms & Conditions

Effective Date: May 19, 2025 

By booking a service with Nova Vida Picnic, you agree to the following terms and conditions:

1. Bookings & Payments

  • A non-refundable deposit is required to reserve your picnic.

  • The remaining balance is due 72 hours before your event.

  • Failure to complete payment may result in cancellation without refund.

2. Cancellations & Rescheduling

  • One reschedule is allowed at no charge with at least 72 hours' notice.

  • Second reschedules or any reschedule within 72 hours are subject to a 50% rebooking fee.

  • Same-day cancellations and no-shows are non-refundable.

  • Group events (10+ guests): Cancellations within 7 days are non-refundable. Reschedules may be considered with partial credit depending on notice and scale.

3. Weather Policy

  • We monitor forecasts and offer one complimentary weather reschedule.

  • Additional weather-related changes are subject to a new deposit.

  • Light rain, clouds, or wind do not qualify for cancellation. If we determine weather is unsafe, we will contact you.

4. Travel & Location Setup

  • Travel within 15 miles of Westfield, MA is included.

  • Locations beyond that may incur a $25–$50 travel fee.

  • A Park Support Fee ($25–$50) may apply for public setups, donated directly to support park upkeep.

  • Locations are first-come, first-served. We may adjust the setup based on space, privacy, or terrain. Privacy is not guaranteed in public spaces.

5. Accessibility & Safety

  • Outdoor locations may have uneven terrain, hills, sand, or stairs. We may be unable to access all spaces.

  • Clients are responsible for communicating any accessibility needs in advance.

  • By booking, you assume all inherent risk for yourself and your guests. Please inform all guests of the setup environment.

6. Food, Decor, & Equipment

  • All equipment is to be used as intended.

  • Clients are responsible for any damage or loss.

  • Notify us of food allergies at time of booking. We are not liable for undisclosed sensitivities.

7. Photography & Media

  • By booking, you grant us permission to photograph and share images of your setup on social media and marketing, unless requested otherwise in writing.

  • Nova Vida Picnic retains artistic discretion over event styling. We welcome input, but final creative decisions rest with our team.

8. Artistic Release

  • Every picnic is a custom creative experience. Nova Vida Picnic uses its unique styling and artistic judgment to curate each event.

  • Dissatisfaction with aesthetic or creative judgment is not grounds for refunds.

9. Intellectual Property

  • All creative content, including photos and branded decor, are owned by Nova Vida Picnic.

  • Clients are granted personal-use rights (e.g., social media, personal sharing).

10. Liability & Indemnification

  • Nova Vida Picnic is not liable for injury, loss, weather delays, or guest conduct during the picnic.

  • Client agrees to hold Nova Vida Picnic harmless from any claims related to the event.

11. Force Majeure

  • Neither party shall be liable for cancellation due to events beyond control (e.g., extreme weather, natural disasters, illness, government shutdowns).

12. Conduct

  • Clients agree to provide a safe environment for our team and respect public spaces.

  • We reserve the right to end service early due to unsafe behavior, harassment, or damage.

Privacy Policy

Nova Vida Picnic respects your privacy. This policy explains how we collect, use, and protect your information.

1. What We Collect

  • Name, email, phone number, event details, and preferences

2. How We Use It

  • To manage your booking and communicate updates

  • To provide service and promote special offers (opt-in only)

  • To improve experiences and brand performance

3. Sharing

  • We never sell or share your data.

  • We may use trusted platforms (such as Squarespace, Acuity Scheduling, Stripe, and Mailchimp) to manage bookings, payments, and communications.

4. Your Rights

  • You may unsubscribe from emails at any time.

  • You can request to review or delete your information by contacting novavidapicninc@gmail.com
